In the UK, Lord Justice Jackson’s 2009 review of civil litigation costs in England and Wales led to an enthusiastic embrace of litigation finance as one tool among others “to promote access to justice as a whole by making costs of litigation more proportionate.” Litigation funding allows lawsuits to be decided on their merits, and not based on which party has deeper pockets.
