Claim Assessment

Claim or case assessment generally refers to estimating the risk to prosecute or defend a legal case. We offer this service for both plaintiffs and litigation funders.

CDC will work with plaintiffs to investigate the underlying facts of the case. We will then conduct legal research into, and analysis of, issues raised by the preliminary fact-finding. CDC will identify and weigh the strengths and weaknesses of the case. We will also conduct an initial assessment of the actual value of the damage. There are several methods and techniques that can be used to estimate damages depending on data availability, the applicable legal rules and case specificities.

The culmination of our case assessment is strategic planning based on an overall assessment of the strength and value of the case. This strategic plan includes the case schedule, overall budget based on cost projections for each phase of the case as well as staffing projections and assignments. The strategic plan is the basis for counselling the client on several critical points, as to likely outcomes in settlement and at trial; weighing cost, risk and case value; and recommendations as to how to proceed.
