Litigation Funders
Litigation funders look predominantly to fund meritorious claims for monetary relief whether through contract, tort or restitution, whether brought by single claimants or through class actions, and whether through litigation or arbitration.
One of the services CDC offers litigation funders is assessing the merits and potential financial value of litigation claims. If so requested by a funder, CDC will carefully review the strength of the claim and the evidentiary support, along with the anticipated defences and counterclaims to predict the probability of the action being successful.
We also offer litigation funders involved in class actions our expertise in the area of book-building a class. Book building is a time consuming process – litigation funders have to identify, contact and sign up as many class action group members as possible to funding agreements. Given the additional effort and expense, many class action claims may not be as attractive commercially for litigation funders. This applies particularly to smaller litigation funders who may not wish to devote the significant resources required to book build effectively. CDC is able to offer this important service in a cost-effective way.
